Terms & conditions
These terms govern your purchase of Senior Safe products and your use of the Senior Safe app and website. Please read them carefully — particularly the medical-alert disclaimer in section 9.
Last updated: 15 May 20261. Who you're contracting with
This site and the Senior Safe service are operated by Senior Safe Pty Ltd (ABN [00 000 000 000]), an Australian company registered in New South Wales ("Senior Safe", "we", "us", "our"). By placing an order or using our website or app, you agree to these terms.
2. Products and pricing
We sell the Senior Safe wireless SOS alert kit in two configurations: Set A (Solo Care Kit) and Set B (Couples & Care-Network Kit). Specifications and contents are described on the product pages. We may update product specifications over time, but the headline functionality described at the time of your purchase will be honoured.
All prices are shown in Australian dollars (AUD) and include any applicable GST. Shipping is free within Australia. We do not currently offer subscriptions, recurring billing, or monthly fees.
3. Orders & acceptance
When you place an order, you are making an offer to purchase. We accept the offer when we send you a dispatch confirmation email. Until that point, we may decline an order — for example, if a product is out of stock, if there's an obvious pricing error, or if the order appears fraudulent. If we decline, we'll refund any payment in full.
4. Payment
Payments are processed by Stripe Payments Australia Pty Ltd. We accept Visa, Mastercard, American Express, Apple Pay, Google Pay, Link and Afterpay/Clearpay subject to availability. Your full card details are handled by Stripe and never stored on our servers.
5. Delivery
Delivery is free within Australia and typically takes 2–10 business days depending on your location. Title and risk in the goods passes to you on delivery to your nominated address. Full details on the shipping & delivery page.
6. Returns & refunds
We offer a 30-day change-of-mind return policy at no cost to you. For faulty goods, your rights under the Australian Consumer Law apply in addition to this policy. Full details on the returns page.
7. Manufacturer warranty
Every Senior Safe kit is backed by a 12-month manufacturer warranty against defects in materials and workmanship, on top of (and not limiting) any rights you have under the Australian Consumer Law. Warranty claims are handled via support@senior-safe.com.au.
8. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms is intended to exclude, restrict or modify any non-excludable statutory consumer guarantee.
9. Medical-alert disclaimer (please read)
- The base station sounds a loud (approximately 85 dB) local alarm; and
- The Senior Safe app sends a push notification to the family members and carers you have nominated on the alert list.
Remote notifications require a working internet connection (WiFi or cellular) at the property where the base station is installed. The 85 dB local alarm functions regardless of internet connectivity.
Senior Safe is not a medical device. It is not designed, intended, approved or sold for the diagnosis, treatment or prevention of any disease or condition. Senior Safe products do not include automatic fall detection, ECG monitoring, vital-sign monitoring, GPS tracking, or two-way voice communication. If those features are critical for the intended user, please consider a monitored 4G medical-alert provider instead — we'd rather you have the right product than buy ours unsuitably.
You acknowledge that response times depend on your nominated family members' availability, their phone settings, and external factors outside our control (mobile-network coverage, app permissions, etc.). We strongly recommend testing the system regularly (the app shows test history) and confirming each nominated responder has notifications enabled.
10. The Senior Safe app
The Senior Safe app is provided free to customers who own a Senior Safe kit. Your use of the app is also subject to Apple's App Store Terms and Google Play's Terms, depending on where you downloaded it.
We grant you a non-exclusive, non-transferable licence to use the app for personal, non-commercial use to operate your Senior Safe kit. You may add as many family-member accounts to your kit as you reasonably need, at no additional cost.
The app requires an internet connection. We do not guarantee uninterrupted availability of cloud services. We will use reasonable efforts to provide a reliable service, but cannot exclude all risk of outages from upstream providers (cloud hosting, mobile networks, push-notification gateways).
11. Acceptable use
You agree not to:
- Use the service in violation of any law or regulation
- Resell or rent Senior Safe products without our written consent
- Tamper with, reverse-engineer or attempt to extract firmware from the devices
- Use the service to send messages or alerts to anyone who has not consented to be on the alert list
- Attempt to gain unauthorised access to our systems or other customers' accounts
12. Limitation of liability
To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded:
- Our total liability to you in connection with the product, the app or these terms is limited to the price you paid for the product;
- We are not liable for indirect, consequential, special or punitive losses; and
- We are not liable for any failure of a family member or nominated responder to respond to an alert in a timely or appropriate manner.
Nothing in this section limits or excludes liability that cannot be limited or excluded under Australian law, including under the Australian Consumer Law.
13. Privacy
How we handle your personal information is set out in our privacy policy.
14. Changes to these terms
We may update these terms from time to time. The "last updated" date at the top will change. Material changes apply only to orders placed after the change date — your existing rights as a previous customer are not affected.
15. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute.
